01Purpose

These Terms of Use govern access to and use of the HERITA platform, published by Famistore Inc., Montreal, Quebec, Canada.

By creating a HERITA account, you accept these Terms of Use without reservation.

02Access to the service

Access to HERITA is reserved for adults (18 years of age and older) for creating a Guardian account. Minors may be added to a family space by an adult Guardian.

HERITA reserves the right to suspend or delete any account in the event of a violation of these Terms of Use.

03Account creation

To access HERITA's services, you must create an account by providing a valid email address and password. You are responsible for keeping your credentials confidential.

You agree to provide accurate information and to keep it up to date.

04Plans and subscriptions

HERITA can be started without payment. Paid levels let your Family Home grow in capacity, organization, and depth. Growth is what's limited — never the memory already entrusted to HERITA.

Payments are processed by Stripe. Subscriptions renew automatically unless cancelled before the renewal date. No refunds are issued for the current billing period, except where required by law.

05Guardian obligations

By using HERITA, you agree to:

  • only upload content you own or for which you hold the necessary rights
  • not use the platform for unlawful, fraudulent, or public-order-violating purposes
  • respect the privacy and rights of the members of your family space
  • not attempt to bypass the platform's security measures
  • not upload content that is hateful, discriminatory, or an affront to human dignity

06Content ownership

The content you upload to HERITA (photos, videos, documents, recordings, biographies) remains entirely yours. HERITA claims no ownership rights over your content.

You grant HERITA a limited, non-exclusive license solely for the technical purposes of storage, backup, and delivery in accordance with your instructions.

You may add information and memories about other people — your relatives, living or deceased, including children. HERITA does not verify their consent: it is up to you to act with respect and care. A Home's Guardians can correct the shared information of the family tree.

07HERITA Editions

HERITA Éditions projects (Family Book, Printed Family Tree) are separate from subscriptions. They begin with a request and an editorial interview, then receive a quote; no order is placed online today. The terms of each project (price, timing, production, refunds) are set out in that quote.

08Suspension and termination

To cancel your subscription, write to us via HERITA's Contact page: self-service cancellation from your settings is not available yet. Access to the service continues until the end of the paid period. Your data is retained under the free tier, or its deletion can be requested via HERITA's Contact page.

HERITA may suspend or delete an account in the event of a serious violation of these Terms of Use, after a formal notice has gone unanswered.

09Limitation of liability

HERITA strives to keep the platform continuously available, without guaranteeing a specific availability rate. In the event of prolonged unavailability, HERITA informs users as soon as possible.

Famistore Inc. shall not be liable for indirect damages resulting from use or inability to use the platform, nor for the loss of content due to an event of force majeure.

HERITA is neither a legal or notarial service nor a medical service. The Moral Testament is not a will in the legal sense; La Lignée and the Succession Protocol carry out no legal succession; La Santé provides neither diagnosis nor medical advice.

10Data protection

The processing of your personal data is governed by HERITA's Privacy Policy, available at www.herita.life/confidentialite, and by the Guardian's Oath. These documents form an integral part of these Terms of Use.

11Changes to these Terms

HERITA reserves the right to modify these Terms of Use at any time. Users will be notified of any substantial change by email at least 30 days before it takes effect.

Continued use of the service after notification constitutes acceptance of the new Terms of Use.

12Governing law and jurisdiction

These Terms of Use are governed by Canadian and Quebec law.

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Montreal, Quebec, Canada.
